It is not easy to be a Trustee. Trustees are fiduciaries with numerous duties and high standards of care. Even if a Trustee acts in the best interest of the Trust and all beneficiaries, it is exceedingly easy for a beneficiary to file a lawsuit – also known as a “Petition” – and ask the court to removal and/or surcharge the Trustee.
