Petitions for Instructions

When a Trustee is in a difficult situation where there is potential liability or where the instructions of the Trust are unclear, they may choose to file a Petition for Instructions. This type of Petition asks the Court to either interpret the terms of the Trust or other court order, so that the Trustee can better carry out his or her duties while protecting against liability for making the wrong decision.
However, the Court will not give instructions for every request, as it will not do the Trustee’s job for them. Only in certain circumstances will the Court offer guidance to the Trustee.
