Trustee Removal
Removal or Appointment of Trustee

It is not easy to be a Trustee. Trustees are fiduciaries with numerous duties and high standards of care. Duties include the duty to keep beneficiaries reasonably informed, to provide a notification of Trustee, to account, not to engage in self-dealing, to marshal and preserve the Trust assets, and to make Trust property productive, among others. Even if a Trustee acts in the best interest of the Trust and all beneficiaries, it is exceedingly easy for a beneficiary to file a lawsuit – also known as a “Petition” – and ask the court to removal and/or surcharge the Trustee.
Klinedinst’s Probate and Trust attorneys can help beneficiaries seek removal of a Trustee or can represent Trustee’s in defense of a beneficiary who seeks their removal. We also maintain a highly qualified Professional Liability defense team with the expertise to defend attorneys, professional fiduciaries, and other professionals who are sued in probate and trust related matters.
